Requested Action
To consider the proposed impact fee from City Staff and provide a written recommendation to the City Council.
Recommendation
Public Works recommends approval of the maximum allowable impact fees and approval of the updated impact fee assessment as presented.
Description/History
The provisions in Chapter 395 of the Texas Local Government Code require the City Council to update impact fees and their associated documents (i.e., the Land Use Assumptions and the Capital Improvements Plan) every five (5) years. The City Council adopted a Resolution on August 12, 2024 scheduling a public hearing on September 23, 2024 to consider the revised fees and documents as part of their consideration for the Fiscal Year 2024-2025 Budget.
Freese and Nichols, Inc. presented the Land Use Assumptions to the Capital Improvement Advisory Committee (“CIAC”) at the June 17, 2024 CIAC Meeting in preparation for the impact fees update as required by the provisions in Chapter 395 of the Texas Local Government Code.
The City Council ultimately adopts the collection rate based on input and recommendations from the CIAC and the Department of Public Works. Freese and Nichols, Inc. has prepared a study detailing the methodology, analysis, and results showing the maximum allowable impact fee that the City of Mansfield could assess for water and wastewater programs. Additionally, it should be noted that the methodology provided by Freese and Nichols, Inc. includes utility benchmarking and collection rates with benchmark communities.
