Ordinance - Public Hearing and First Reading on an Ordinance Approving Proposed Amendment of Section 7100, Sign Standards of the Zoning Ordinance to Revise the Regulations Under Which Signs on Vehicles may be Displayed (OA#15-004)

Requested Action

To consider the subject ordinance amendment.

Recommendation

The Planning and Zoning Commission held a public hearing on October 19, 2015 and voted 5-1 (Horn abstained) to recommend approval with a recommendation that signage four square feet or smaller on vehicles be exempt.  Commissioner Polozola was absent.

Description/History

The City Council initiated the proposed amendment and directed the Planning and Zoning Commission to forward a recommendation. The proposed amendment will revise the regulations on Signs on Vehicles to read as follows:

 Signs on Vehicles: Signs advertising a business, service or product shall be permitted on vehicles including trucks, trailers, bus and passenger vehicles. On properties zoned OP, C-1, C-2, C-3 and PD Districts with office, retail or commercial uses, such vehicles shall be parked on the premises of the business being advertised at least forty (40) feet from the public street right-of-way and not in the parking spaces or drive aisles adjacent to the street right-of-way or street landscape setback. This requirement shall not apply to any vehicle off the business premises in the active conduct of business such as making deliveries or serving a customer. The Director of Planning may approve an alternative parking location where the literal enforcement of this requirement will result in an unnecessary hardship due to the exceptional narrowness, shallowness, shape, topography or other extraordinary physical condition related to the business premises.

The proposed regulations will set vehicles with signs further back from the street and lessen their impact on the general public. Properties with unique physical conditions will be reviewed by the Director of Planning on a case by case basis.

Please note that the proposed regulations will not apply to land uses under the heading of “Educational, Institutional and Special Uses” in the Permitted Use Table.

The new regulations will apply to existing vehicles with signs.  Non-conforming use rights will not apply.
