Requested Action

To consider the subject ordinance amendment.

 

Recommendation

The Planning and Zoning Commission held a public hearing on October 19, 2015 and voted by 4-2 to recommend approval. Chairman Wilshire and Commissioner Hudson voted in opposition.  Commissioner Polozola was absent.

 

Description/History

First Reading - October 26, 2015

The City Council initiated the proposed amendment and directed the P&Z to forward a recommendation. See attachments for full details on the subject amendments.

The amendments in Section 4400B, Permitted Use Table fall in the following general categories:

- Require specific use permit and site plan approval for certain uses; e.g. gas station, used car lot and certain vehicle related uses, used merchandise store, discount stores, warehouses, recycling collection centers, uses not elsewhere listed, truck parking lots, and most heavy commercial uses in C-3 zoning

- Remove uses that are not in the city currently and possibly not in the future; e.g. wrecking and salvage yard, drag strip, sand or gravel extraction

- Remove uses from C-2 zoning; e.g. mini-warehouses, RV park, coin-operated laundry

- Remove certain retail, service or non-industrial uses from industrial zoning to preserve vacant industrial properties; e.g. nursing home, hospitals, day care, jewelry store, gift store, other small format retail

- Fill in "permitted" for certain uses under Planned Development zoning where "P" is missing

- Keep the frequency of promotional sign display at 3 times per year

- Strike the waiting period between display to allow more flexibility

- Regarding gorilla or similar shape balloon signs - City Attorney and Staff advise either delete balloon sign or allow any of them for 14 days; further legal advice will be provided if desired by Council

The amendments in Sections 2200, 5300, 7200B, 7301 and 7800 coincide with the amendments in Section 4400B.

The new regulations will not apply to any development that has acquired vested right under state law.
