Requested Action
Approve the minor modification to the approved development plan of the submect Planned Development.
Description/History
The City Council approved the Planned Development for the Dalton Best Maid pickle plant on November 13, 1996. The Council subsequently approved a minor modification to the development plan in 1999, and then again on July 27, 2009. The applicant is requesting another modification to change the material of the screening wall and to allow an additional month to complete the screening and landscaping.
The original development plan calls for a “brick screening fence” or “brick wall” along E. Debbie Lane and N. Main Street. In his July 22nd letter, the applicant requested that “a stone or masonry wall also be allowed rather than restricting the wall only to brick.” The City Council approved this request and stipulated that the wall be eight feet in height.
The Zoning Ordinance defines masonry as brick; natural or manufactured stone; structural clay tile; indented, hammered or split-face concrete masonry unit or combination of these materials that are laid up unit by unit and set in mortar and that are at least two inches thick. The Building Code also refers to various types of masonries as brick, stone, clay or other materials bonded in mortar or grout.
In his current request, the applicant is requesting that the city allow a precast screening wall with the appearance of stone in place of masonry construction. The applicant is also requesting an extension of the landscaping and irrigation installation deadline from December 31, 2009 to January 31, 2010. Further details are offered in the applicant’s letter.
Section 5100 of the Zoning Ordinance states that: “Proposed revisions or modification to an approved development plan shall be noted and shown………., copies of the proposed revised plan shall be submitted to the City Council for its review………If, in the City Council's determination, said revised plan does not constitute a significant change, no public hearing shall be called and the revision shall be deemed approved.”
