Discussion and Possible Action Regarding Moratorium and Staff Recommendations on Medical Waste Processing, Treatment, Transfer, Collection or Storage Facilities

To consider the staff recommendations.
Recommendation
Staff recommends that the Zoning Ordinance be amended to require a Specific Use Permit (SUP) for the subject land use in I-1 and I-2 industrial zoning. A SUP requirement will provide a detailed site plan for staff and Council to adequately evaluate impact and compatibility. Staff also recommends the following Special Conditions to help mitigate potential issues related to this type of facilities:
1. All medical waste processing, treatment and storage areas or equipment must be within a building completely enclosed by four walls and a roof shown in the detailed site plan approved by the City.
2. The liquid waste discharge from medical waste processing, treatment or equipment cleaning must be contained in storage tanks within the building and be removed by a service provider qualified to handle such liquid waste discharge. Liquid waste discharge must not be disposed of into the City's sanitary sewer system.
3. The facility must comply with the requirements of the City's Industrial Sewer Pre-Treatment Program.
4. The steam, gas or emissions from the processing or treatment equipment and storage tanks must be contained in a closed system within the building and not be emitted into the atmosphere.
5. Doors, entries or openings into the medical waste processing or treatment area must remain closed at all times except for brief periods to send or receive products.
6. To prevent odor, air scrubbers must be installed to process any air exchange from the building interior to the atmosphere.
7. Security must be provided around the clock to protect the property against sabotage, trespass and vandalism.
8. The facility must obtain all applicable state and/or federal permits authorizing the receipt, processing, treatment, collection, transfer, storage and disposal of medical waste products.
9. A secondary power source must be designed and installed on premises to operate the facility during an extended power outage.
In addition, the current conditions of approval for Specific Use Permit in Section 6100 of the Zoning Ordinance will be taken into consideration:
1. That the SUP will be compatible with and not injurious to the use and enjoyment of other property, nor significantly diminish or impair property values within the immediate vicinity;
2. That the establishment of the SUP will not impede the normal and orderly development and improvement of surrounding vacant property;
3. That adequate utilities, access roads, drainage and other necessary supporting facilities have been or will be provided;
4. The design, location and arrangement of all driveways and parking spaces provides for the safe and convenient movement of vehicular and pedestrian traffic without adversely affecting the general public or adjacent developments;
5. That adequate nuisance prevention measures have been or will be taken to prevent or control offensive odor, fumes, dust, noise and vibration;
6. That directional lighting will be provided so as not to disturb or adversely affect neighboring properties;
7. That there are sufficient landscaping and screening to insure harmony and compatibility with adjacent property.
