Requested Action

Consider an Ordinance adding provisions for the regulation of commercial vehicles parking within the City.

 

Recommendation

Staff recommends passing of the Ordinance.

 

Description/History

The City has seen an increase in the number of commercial vehicles parking overnight in parking lots and other areas of the City.

 

In order to address this concern this ordinance would provide provisions which would regulate the parking of commercial vehicles in the City.  The proposed ordinance would extend liability for any violations of this ordinance to the property owners, which in the case of a commercial establishment would also include the Property Manager of agent.

 

Added Section 71.31 adds a provision making it unlawful for a commercial vehicle to be parked in specified areas in the City.  If the Commercial Vehicle remains on the property in violation of this ordinance for over 48 hours, the vehicle is subject to towing.

 

The ordinance further provides exceptions to the violations.

 

Justification

Parking commercial vehicles in certain areas may create safety hazards including obstructed roadways and visibility issues or otherwise impede the public health and safety.  Regulating the parking of these vehicles would assist in maintaining the safety of these areas.
