Requested Action

Approve the Resolution authorizing $117,961.50 in funding for the removal and replacement of landscape screening surrounding gas well located Near 621 Easy Drive on MEDC property.

Description/History

When MEDC acquired the approximately 155 acre parcel of land south of Easy Drive, referred to as Mansfield International Business Park (MIBP), in 2017 there was a gas well pad site on the property which is now owned and operated by United Production Partners Resources / Enervest (UPPR).  UPPR has the surface rights to the MIBP property. As part of the negotiation process in selling the land to Seefried Properties (Amazon) in 2020, MEDC obtained a surface rights waiver to the entire property. This not only helped in closing the sale with Seefried but also eliminates any concerns for future buyers of the remaining acreage. The Surface Use Agreement was executed in February 2021.

 

On July 29,2021 City of Mansfield Code Enforcement issued a non- compliance notice to UPPR due to dead and overgrown landscaping around the gas well pad site. After discussion with outside counsel, staff became aware that the Surface Use Agreement requires the surface property owner (MEDC) to be responsible for maintaining the required landscape screening.

 

MEDC staff advertised two best value public bids for this work. One for the removal and replacement of the landscaping / irrigation and one for the ongoing maintenance of the landscaping and irrigation. The bids were opened on January 28th at 10:00am.  There were three bidders for the removal and installation of the landscaping / irrigation and two bidders for the ongoing maintenance.(See attached bid tabulations)

 

Staff reviewed each of these bids and made a recommendation to the MEDC Board at their March 1st meeting to award the bid for removal / replacement/ repair to AJ Constructing, LLC. The amount of this bid was $117,961.50. The MEDC voted unanimously to award the bid to  AJ Constructing, LLC.  The lowest bid was submitted by Azul Construction, however they did not comply with all of the bid requirements.

 

Justification

Performing this work will bring MEDC into compliance with existing ordinances.
