Description/History

The bid opening for Phase I of the Pond Branch Linear Park trail project was held on February 23, 2017, with five firms submitting bids. Klütz Construction, Inc. was the lowest qualified and responsive bidder. A construction contract in the amount of $2,212,156.70 was awarded by the City Council on March 6, 2017.

 

In June of 2017, Change Order #1 was issued by the department in the amount of $46,672.40. This change order included the deduction of the Oak Street connection, as well as the addition of significant retaining wall extensions and several small unforeseen items.

 

Since that time, modifications to the original design have occurred as a result of the project site conditions and adjacent commercial development in the downtown area. Change Order #2 was proposed to allow the contractor to perform construction activities that meet the revised design specifications.

 

As the construction activities on the west side of the creek between Broad Street and Elm Street were completed, the bank erosion on the east side of the channel north of Broad Street adjacent to the Heritage Baptist Church parking lot became more evident. This area was evaluated through the Engineering Department and determined that a permanent fix needed to be addressed. The Engineering Department retained Graham and Associates to design the necessary retaining wall, and then requested that the construction of the wall be added to the Pond Branch Linear Park project as Change Order #3.

 

The requested change includes the addition of 107 linear feet of retaining wall with footing at the creek bottom on the east side of the channel. The net amount of the requested Change Order #3 with Klütz Construction, Inc. is $116,295, bringing the revised construction contract total to $2,561,582.20. This final change is within the allowable extent that a contract can be changed.

 

Justification

As development occurs along the creek, this trail will provide additional benefits for outside patio dining areas and connections to other venues in the downtown areas from the Walnut Creek spine trail by providing improved pedestrian access. The change order represents an item required to protect the adjacent property owner (Heritage Baptist Church) and tenant (City of Mansfield Parking lot lease), to enhance trail safety and improve aesthetics of the trail system.
