Description/History
The city contracted with Brittain & Crawford on June 22, 2009 for an amount not to exceed $30,700.
 
Throughout the design of the 35th Year CDBG project it became apparent that the City's topographic maps, which were used to delineate drainage patterns and watersheds, lacked sufficient detail to allow for an accurate determination of reported drainage issues impacting surrounding property owners.  Therefore it was necessary to obtain additional off-site survey to facilitate a re-design of certain aspects of the project.  In addition it was necessary to prepare two additional Right of Way documents and two additional Drainage Easement documents to properly encompass the re-designed improvements.
 
There were also atypical legal issues that Brittain & Crawford assisted in resolving during the City's negotiations for right of way with a particular property owner.  This property owner was physically impaired to the extent that signing a document was not possible and they had not imbued anyone else with Power of Attorney.  Brittain & Crawford had consultations with attorneys and crafted additional documents and procedures that allowed this property owner to consent to having a relative sign the documents.
Justification
The items described above were not part of the original contract scope and there completion required that Brittain & Crawford incur additional expense.  Brittain & Crawford can accomplish the remaining survey tasks to complete the project for a total not to exceed $9,600.
The Public Works Director will be in attendance at the meeting to answer Council's questions regarding the proposed contract amendments. A resolution is attached for Council's consideration.
 
Funding Source
The funding source will be from the street bond funds.
