Title
Ordinance - Second Reading of an Ordinance Approving a Request to Abandon Part of a 7.5 - Foot Utility Easement in Lot 9, Block 5, Twin Creeks Addition, Phase Five, by Garrett E. Toomey and wife, Natalie M. Toomey

Requested Action
To consider the subject easement abandonment.

Recommendation
The Engineering Staff recommends the approval of the Utility Easement Abandonment Lot 9, Block 5, Twin Creeks Addition, Phase Five.

Description/History
The purpose of the easement abandonment request is to accommodate a swimming pool that the home buyer would like to construct on the property.  The subject easement is adjacent to a 50' drainage easement along the rear property line.  Abandoning the 7.5' wide 90' long utility easement will increase the usable area in the rear yard to accommodate the pool.

Justification
The franchise utility companies have consented to the proposed easement abandonment.  The City currently has no public utilities within the easement and does not anticipate needing it in the future.
