Requested Action
Consider approval of cost participation with the developer on public utilities in the Bower Ranch Subdivision.
Recommendation
The Engineering Staff recommends the approval of the Developer Agreement to participate in the cost of public utilities in the Bower Ranch Subdivision.
Description/History
There is an existing 12” water line and 12” sanitary sewer line located along a property boundary in a utility easement that was installed by MISD to serve Lake Ridge High School. The property adjacent to these utilities is now being developed as the Bower Ranch subdivision. The current location of those utilities will end up being in the backyards of several lots, which causes concern for the Engineering Staff and Utility Department Staff.
Justification
The Engineering Staff met with the Utility Department and it was concluded that the current location of the utilities would be an accessibility and maintenance issue for the Utility Department in the future as well as severely limit the usability of the backyards for future residents. The engineering staff had the developer’s design engineer reroute the water and sewer line through public right of way for better access and future maintenance. Because the development would require an 8” water line and 8” sewer line to serve its lots, the cost participation is for the oversize only and will be actual construction cost for an amount not to exceed $95,942.00.

The Director of Public Works will be in attendance at the meeting to answer Council’s questions regarding the proposed contracts. A Developer’s Agreement is attached for Council’s consideration.
