Requested Action
Pass resolution to deny Atmos Mid-Tex's proposed rate increase pending further settlement discussions and to prevent Atmos' proposed rate increase from automatically taking effect on June 11, 2012.
Recommendation
Staff recommends that council adopt a resolution denying Atmos Mid-Tex's proposed rate increase.
Description/History
On or about January 31, 2012, Atmos Mid-Tex filed with the City of Mansfield a Statement of Intent to change gas rates in all municipalities exercising original jurisdiction within its Mid-Tex Division service area, effective March 6, 2012. The City suspended the effective date of Atmos Mid-Tex's proposed rate increase for the maximum period allowed by law and thus extended the City's jurisdiction until June 4, 2012. On April 25, 2012, the Company extended the effective date for its proposed rates by one week, which similarly extended the City's jurisdiction until June 11, 2012.
Justification
Staff would like to deny the June 11, 2012, effective date of Atmos Mid-Tex's rate.
