Description/History
The City of Mansfield and the Texas Department of Transportation (TxDOT) entered into a Local Project Advance Funding Agreement (AFA) on September 2, 2015 for the construction of the Historic Mansfield Hike and Bike Trail Connection. The project includes a 12’ wide concrete pedestrian and bicycle trail with amenities that would connect Historic Mansfield along North Main Street to the city-wide linear park trail system, new curbs and concrete barriers to narrow the roadway for traffic calming, wrought iron fencing, street and pedestrian lighting for ambience and provide managed drive approaches along the street.
In order to prepare the project for the bid advertisement phase, TxDOT is requesting a First Amendment to the AFA to comply with their current program requirements. The amendments proposed do not represent major changes. A summary of the changes is listed below:
· Section 1.2 - changes the beginning and ending dates for performance.
· Section 2.4(d) - deleted from the original agreement; it allowed for termination if a construction contract had not been awarded in 3 years.
· Section 4.1 - changed the description of the trail from “12 foot wide pedestrian and bicycle trail” to “0.4 mile Bike/Pedestrian Trail.”
· Sections 5.12 and 7.4 - instead of requirements in these sections needing to be performed by City 45 days prior to construction date, now requirements must be met prior to “advertisement for bids.”
· Sections 11.8 and 11.9 - money paid by City will go to TxDOT and not the trust fund as listed in original agreement.
· Article 20 - Re-worded and re-numbered, but there is no substantive change...
