Requested Action
To consider the subject ordinance amendment.
Recommendation
The Planning and Zoning Commission held a public hearing on May 20, 2013, and voted by 6 to 1 to recommend approval with the following modifications:
1) Add a requirement that political signs must be removed 14 days after an election
2) Keep the maximum size of political signs on private property at 16 sq ft as in the current regulations
Commissioner Neuman voted nay after learning that the draft amendment has already been reviewed by the City Attorney and that state law prohibits regulations on political signs less than 36 sq ft on private property.
Description/History
Per Council's suggestion on May 13, Staff has removed the height and size restrictions plus the distance requirements from the curb and intersection, and we have reduced the separation requirement for political signs of the same candidates and issues from 500 to 100 feet. We have added the P&Z's recommendation pertanining to the removal of signs after the election, but not the sign size limit on private property that is inconsistent with state law.
The proposed amendments was prepared at Council's request to address the following issues:
- impose a spacing requirement on political signs
- prohibit unauthorized use of city logo
- prohibit signs from other cities' candidates
- deal with dilapidated political signs
- penalty for vandalism of signs
