HLC#24-009: Discussion and Possible Action Regarding the Regulations Allowing the Suspension of Demolition Permits for Historic Properties
Description/History
As a Certified Local Government (CLG), Mansfield is required to adopt and maintain a local historic preservation ordinance that includes a stay on the demolition of designated historic properties for a minimum of 60 days. The purpose of the stay is to give the applicant time to consider alternatives to demolition and to work with preservation-based organizations and city staff.
There are two provisions related to suspension of a demolition permit in Section 155.069 of the Mansfield Code of Ordinances, “H, Historic Landmark Overlay District regulations”, Subsections (G) and (I).
Subsection (G) applies to the Commission’s ability to suspend a demolition permit for a designated Historic Landmark. The suspension is for 90 days, unless the Commission requests an extension of 120 days from the City Council. Subsection (I) is similar, except it applies to properties eligible to be designated as landmarks. A copy of these subsections is attached for the Commission’s reference. Please note that the suspension of a demolition permit is not permanent. At the end of the suspension period, the City must issue the demolition permit even if nothing has been done to preserve the building.
Staff would like to review these provisions with the Commission and discuss a process to implement them should the Commission determine that the demolition of a historic resource will adversely affect any historical, architectural, archaeological, or cultural feature of the building.
As a CLG, the City is required to certify annually that the suspension provisions are in force and to report the number of historic resources demolished each year.
