Requested Action

To consider the subject zoning change request.

 

Recommendation

The Planning and Zoning Commission held a public hearing on January 4, 2016 and voted 6-0 to recommend approval.  Commissioner Polozola was absent.

 

Description/History

The existing MF-2 zoning is left over from the early 1980s. The current owner plans to subdivide the property for single-family residential use. There is an existing house on the southern portion of the property.  The owner plans to build one additional house on the northern portion.

The owner also owns the lot to the east at 2109 Cain’s Lane in Pleasant Acres Addition. He intends to build a house on that lot and will not be subdividing it. The property being considered for zoning change is not part of Pleasant Acres Addition and is not subject to its deed restrictions.

The existing house is accessed via a driveway across 2109 Cain’s Lane. The new house will also access Cain’s Lane via either the existing driveway or a new driveway.

A petition of protest was submitted at the Planning & Zoning Commission meeting. Only 8.65% of the 200’ notification area is represented by the petition, and therefore, it will not trigger a super-majority vote requirement.
