Requested Action

Consider the proposed amendments.

 

Recommendation

Staff recommends approval.

 

Description/History

October 12 - First Reading

The current garage sale regulations were last revised in 1986.

The proposed amendments will reduce the number of garage sales from 3 to 2 times a year. Cities like Arlington, Grand Prairie, Southlake, and McKinney only allow two garage sales a year.

In addition, the proposed amendments will:

- enact new restrictions to prevent a garage sale from turning into a commercial enterprise

- incorporate policies that are currently in the garage sales permit application guidelines and sign regulations

October 26 - Second Reading

The proposed ordinance has been revised to show that the 2 garage sales sill be permitted only in the months of May and October.

 

November 9, 2015 - Third Reading

The attached Exhibit A for the proposed ordinance has been revised to:

- remove the provision restricting garage sales to May and October only

- add a provision to allow two estate sales per premise per calendar year

- add a definition of estate sale

- add a variance provision to allow more than two garage sales or estate sales per year with Council approval due to special circumstances not simply a hardship related to convenience
