Requested Action
To consider the subject zoning change request.
 
Recommendation
The Planning and Zoning Commission held a public hearing on July 21, 2014 and voted 6-0 to recommend approval.  Commissioner Smithee was absent.
 
Description/History
The applicant is the owner of Jalisco's Mexican Restaurant that has occupied the property for a number of years. With the improvement of W. Oak Street, he has proposed to expand the restaurant with patio seating towards the sidewalk. The expansion will be in the 25' required setback of the current zoning. The C-4, Downtown Business District has no setback requirements. Last year, the City Council approved C-4 zoning for the property occupied by Mellow Mushroom for similar reasons. Jalisco's proposed expansion will be compatible with the rest of the downtown businesses.
