Ordinance - Third and Final Reading of an Ordinance of the City of Mansfield, Texas, Amending Chapter 92, "Health and Sanitation", of the City of Mansfield Code of Ordinances, as Amended, by Amending, Revising, and Modifying the Regulations for Public Pools, Spas, and Interactive Water Features; Providing that this Ordinance shall be Cumulative of all Ordinances; Providing a Severability Clause; Providing a Savings Clause; Providing a Penalty Clause; Providing for Publication, and Providing an Effective Date

Requested Action
Approve attached amendments to the existing Public Pools, Spas and Interactive Water Features Ordinance

Background
The City of Mansfield has contracted with Tarrant County Health Department to regulate Interactive Water Features for the past 20+ years.  In addition to the City of Mansfield, the Tarrant County Public Health regulates Health and Sanitation codes in the unincorporated areas of Tarrant County as well as 31 other cities

Justification
Tarrant County Health Department has requested that the City of Mansfield revise their Health and Sanitation Code regarding the regulations of Public Pools, Spas and Interactive Water Features to bring them in line with Tarrant County's model ordinance.  Tarrant County's model ordinance incorporates the State Health Code requirements and Tarrant County Health requirements adopted by the other 31 cities under contract with them.  Though now major changes were made to the existing City of Mansfield ordinance, the changes made will bring the City's regulations in line with the other cities they perform these services for

Funding Source
All permit and fees are issued and collected directly by the Tarrant County Health Department and are not included in the City of Mansfield budget.
