Title

Ordinance - Third and Final Reading on an Ordinance Approving a Specific Use Permit for Eating Places with Drive-Through Service on Approximately 1.17 Acres, Generally Located South of E. Broad Street and Approximately 650’ East of SH 360; PC Chicken 3, LLC Slim Chickens (ZC#15-025)

Requested Action

To consider the subject zoning change request.

Recommendation

The Planning and Zoning Commission held a public hearing on December 21, 2015, and voted 6-0 to recommend approval.  Commissioner Horn was absent.

Description/History

The proposed SUP is for a Slim Chicken restaurant with a drive-through window.  It is located east of the lot housing Schlotzsky’s. The two lots will be separated by 40’ of required landscape buffer with trees.

The applicant has met all the requirements for a restaurant with drive-through service as well as the architectural design standards.

Second Reading - January 25, 2016

The applicant revised the site plan to show evergreen trees and a larger patio, but declined the request to change to the roof ridge line (see attached letter).

Third Reading - February 8, 2016

In an effort to make waterproofing easier at the rear elevation, the applicant changed the facade material of the rear gable from brick to hardie panels. It matches the materials used on part of the front gable. All other exterior walls below the top plate will still have a brick and stone facade.
