Ordinance - Third and Final Reading of an Ordinance of the City of Mansfield, Texas Amending Ordinance No. Or-1799-11, Amending the Schedule of Drainage Charges for the Mansfield Municipal Drainage Utility System Against all Real Properties within the City and Clarifying Certain Exemptions from said Charges and the Rights and Duties of Land Owners,  Pursuant to the City’s Authority Under Subchapter C of Chapter 552 of  The Texas Local Government Code;  Providing a Severability Clause and an Effective Date

Requested Action

Approval of the ordinance.

Recommendation

The Environmental Department staff recommends the approval of this ordinance.

Description/History

Staff has amended the language of the proposed ordinance to match the rates of Proposal 2. This includes a residential rate of $6.50/hh and $5.00/unit for mobile homes. For non-residential properties, Schools and Churches are provided a discount to $6.50/ac. All other non-residential properties rates are $53.70/ac which equates to roughly $4.50 for 3,650 square feet of impervious area.

 

Staff had attorneys at TOASE review the final language. Some edits were made from the previous reading.

 

An effective date of the rates was established as January 1, 2016. Staff is moving forward with the development of a utility bill insert that is planned to be mailed in November to all utility customers informing them of the upcoming rate increase. Additionally, for non-residential customers, the insert will explain how their monthly charge is calculated.

 

Other housekeeping items in some portions of the ordinance were amended as well.

 

Justification

Additional funds are needed in order to maintain drainage infrastructure, meet State permit requirements and provide the expected level of service for residents and businesses.
