Requested Action

To consider the subject plat.

 

Recommendation

The subdivision conforms to the Mansfield Subdivision Ordinance and the requirements in Chapter 212 of the Texas Local Government Code, with approval of the requested variance.

 

The Department of Planning and Development Services recommends approval of the plat with the variance.

 

Description/History

The property owner currently has a house and accessory buildings situated on two separate tracts of land. This plat proposes to consolidate into a single lot, ensuring all existing structures are located on the same property.

 

The plat adheres to the requirements of the Subdivision Control Ordinance, with the exception of the following provision:

 

                     Section 10(M)(9): Each lot must front upon a public street.

 

Proposed Lot 1 does not have direct frontage on a public street. The applicant has requested a variance for this requirement. An existing residential tract located between Lot 1 and Carlin Road prevents Lot 1 from having direct street frontage.

 

Lot 1, Block 1 of Doty Addition is accessed via an existing 30-foot-wide common access easement through the front property from Carlin Road. This easement also extends through Lot 1, Block 1 of the Nelson Addition, located behind the proposed lot.

 

Staff finds that granting the variance request is both reasonable and justified.
