Requested Action
To consider the subject zoning change request.
Recommendation
The Planning and Zoning Commission held a public hearing on August 5, 2013 and voted 6-0 to recommend approval. Commissioner Polozola was absent.
Description/History
As suggested by City Manager, staff has prepared a comparison chart for the current zoning regulations and the C-2 regulations (current zoning shown in blue). We have advised the applicant that they should change their request to ask for the same zoning as the new Kroger store and submit site plans for the Council's approval in future meetings.
The subject property is currently part of the Neighborhood Center Two Sub-District of The Reserve PD. The applicant is seeking a zoning change to develop under the regular C-2 development format; i.e. pad sites along the street and a few small to mid size retailers in the back.
North of the subject property across E. Broad Street is undeveloped C-2 zoning. Just west is an existing Sonic restaurant and east is the new Kroger development.
Staff is confident that the C-2 regulations will ensure quality architectural and landscape designs and the proposed development format will be compatible with other developments along this stretch of East Broad Street.
The Kroger Real Estate Department sent the attached written opposition after the P&Z public hearing. The limited area of Kroger's lot is within 200 feet of the zoning change will not trigger the 6-1 super-majority vote requirement.
