Requested Action
To consider the subject zoning change request.
Recommendation
The Planning and Zoning Commission held a public hearing on May 16, 2016 and voted 5-2 to recommend approval. Commissioners Hudson and Polozola voted nay.
Description/History
First Reading
The existing PD on the property was adopted in August 2007. At that time, the property owner was seeking C-2 zoning. However, the Council had concerns about the broad scope of uses and rezoned the property to PD with limited C-2 uses. Ray’s Pharmacy was subsequently constructed. The remainder of the PD was saved for limited C-2 uses and compliance with C-2 standards except for a deviation to the screening and landscaping along the property line shared by Willie Brown Elementary School.
The proposed amendment to the PD will remove mini-warehouse from the list of prohibited uses (see redline attachment). The detailed site plans for the three-story mini-warehouse project is provided for review. The architecture of the building has been designed to compliment the existing businesses along E. Broad Street.
Second Reading
A note has been added to Exhibit C stating the windows for the mini warehouse building will be opaque except for the office. Additionally, the wall sign will be relocated to the West Elevation prior to final reading.
The applicant met with MISD on Wednesday, 22 June 16, and discussed the screening/landscaping for the diving property line. MISD has no issue with the living wall and chain link fence currently in place, however they did ask the applicant to insert vertical plastic privacy slats, which has been agreed upon. A note will be added to the PD prior to final reading.
