Description/History

The Texas School Safety Center at Texas State University on behalf of the Department of State Health Service, Tobacco Prevention and Control Branch has received funds for enforcement of Health and Safety Code, Chapter 161, Subchapters H, K, and N relating to distribution, sales and use of cigarettes or tobacco products to minors.  The State of Texas bans the sale of tobacco and tobacco products  to persons less than 18 years of age.  The 75th Legislature passed one of the strongest and most comprehensive tobacco laws in the country.  For purposes of this grant, two key provisions of these laws include: 1) prohibits minors from buying or using tobacco products, and 2) requires retailers who sell tobacco products to ask for proof of identification from anyone purchasing whom appears to be under 27 years of age.

Justification

On behalf of the State Health Service, police departments are authorized to inspect stores that sell any tobacco or e-cigarette product.  In order to determine if laws are being adhered to, inspections will be held randomly and unannounced.  The Mansfield Police Department is eligible to receive up to $3,900 for random inspections conducted in FY2016.
