Requested Action
Consider approval of the request to abandon part of the drainage easement north of National Parkway and east of S. Holland Rd. to the Hott Family Limited Partnership.
 
Recommendation
Staff recommends approval of the request to abandon part of the Drainage Easement north of National Parkway and east of S. Holland Rd. to the Hott Family Limited Partnership.
 
Description/History
In November of 2000, the drainage easement was dedicated in what was planned to be the future right-of-way of National Parkway.  The alignment for National Pkwy has since changed and the first phase has already been constructed.  As part of a Developer's Agreement, Taurus of Texas GP, LLC relocated the channel that was in the existing drainage easement into the new alignment of the National Parkway right-of-way.  The old channel has been filled in and storm water has been redirected into the new channel; therefore the drainage easement on the Hott Family Limited Partnership's land is no longer required.
 
Justification
There are currently no utilities or drainage structures within this drainage easement.  The channel has been filled in and storm water has been redirected into the new channel located in the right-of-way of National Parkway. The City will be relieved of its current maintenance responsibilities and has no future need for the easement to be abandoned.
