Recommendation

Approval of Resolution Canceling the May 7, 2016 General Election

Description/History

On February 8, 2016 the City Council approved Resolution No. RE-3206-16 ordering a general election to be held May 7, 2016 for the purpose of electing Mayor, Place 1 and Council Member, Place 2.  The filing period for placement on the ballot began January 20, 2016 and concluded February 19, 2016.  The deadline for the list of write-in candidates was February 23, 2016.  One application was received for each place on the ballot.  A general election may be canceled if each candidate for an office that is to appear on the ballot is unopposed.

Following receipt of the Certification of Unopposed Candidates, the Council may declare each unopposed candidate elected to office and take action to cancel the election.  The attached resolution declares each unopposed candidate elected to office and cancels the general election scheduled for May 7, 2016.  To complete the cancellation process, a copy of the resolution canceling the election will be posted on election day at each polling place that would have been used in the election.  Certificates of election may be issued after election day.  After the prescribed canvassing period, the candidates may be sworn in and assume their duties.

Justification

The General Election scheduled for May 7, 2016 is eligible for cancellation pursuant to Section 2.051 of the Texas Election Code.
