Requested Action
To consider the subject easement abandonment.
Recommendation
The Engineering Staff recommends the approval of the Drainage Easement Abandonment in the D. Delay, Survey Abstract No. 209.
Description/History
The easement was originally obtained by the developer of the Lonestar Ranch Phase 2 subdivision to accommodate a storm drain discharge location. The easement and alignment for the earthen swale that was designed to accommodate the storm water passed over a 50' gas pipeline easement. During construction it was discovered that the gas pipelines were shallower than expected and therefore the necessary grading could not be completed. A new easement was obtained and a new earthen swale alignment was constructed that allowed for proper discharge of the storm water, making the old drainage easement obsolete.
Justification
The original alignment of the easement was meant to convey public storm water by means of an earthen swale. The earthen swale has been realigned in a new easement; therefore there is no current or future need for the existing easement.
