Requested Action

To consider the subject easement abandonment.

 

Recommendation

The Engineering Staff recommends the approval of the Utility Easement Abandonment on Lot 1, Block 1, Villas di Lucca Addition.

 

Description/History

The 15' utility easement on Lot 1, Block 1, Villas di Lucca Addition was created to accommodate a 12" public sanitary sewer constructed in conjunction with Lifetime Fitness of Mansfield in 2009.  The proposed layout of the Villagio Apartment project necessitated a relocation of a portion of the 12" public sanitary sewer within the limits of the project.  An easement to accommodate the new sanitary sewer was created by the developer with the Villas di Lucca Addition plat.  The new sanitary sewer has now been constructed by the developer, accepted by the City of Mansfield and is in operation.  The 15' utility easement along the abandoned portion of the sanitary sewer may now be abandoned.

 

Justification

A utility easement was created and a new 12" public sanitary sewer was constructed at the sole cost of the developer.  The utility easement containing the now abandoned portion of the 12" sanitary sewer can now be abandoned at no cost or impact to the City of Mansfield.
