Title
Ordinance - Third and Final Reading of an Ordinance to Abandon a Portion of Right-of-Way along the South Side of Cannon Drive East of Miller Road

Requested Action
Consider approval of the abandonment of a portion of right-of-way along the south side of Cannon Drive east of Miller Road.

Recommendation
Staff recommends approval of the abandonment.

Description/History
The land area of the proposed abandonment is not used or needed in the future for Cannon Drive or any other planned roadway by the City of Mansfield.  This section of Cannon Drive is already improved to the ultimate section as recommended in the Thoroughfare Plan.  Staff has no knowledge of this area ever having been dedicated or acquired by other means by the City.  Raymond Meeks, attorney, discovered through deed research that in past transactions the area was left out of the deed description of the adjacent tracts owned by Paul and Paula Sutton.

Justification
There is no use for this property now or in the future by the City.  It is legal and appropriate to record a quit claim by the City so the adjacent owner can make use of the land.
