Reconsideration of Action Taken by the City Council on Item #17-2199 during the Regular Meeting held February 27, 2017

Description/History
A public hearing was held before the City Council on February 27, 2017 to consider the request for a variance to allow the sale of alcoholic beverages for off-premise consumption by Carnicera Carmelita Meat Market located at 1275 N. Main Street, within 300 feet of the property line of Legacy High School. Following the public hearing and discussion, a motion was made to deny the variance which failed by a vote of 3 in favor (Broseh, Burgess, Lindsey) and 4 against (Cook, Haynes, Hoffman, Newsom). A subsequent motion was made to approve the variance which passed by a vote of 4 in favor (Cook, Haynes, Hoffman, Newsom) and 3 against (Broseh, Burgess, Lindsey).

On March 2, 2017, the City Secretary's Office received a request from Council Member Newsom, supported by Council Members Haynes, Hoffman, and Burgess, to place the variance granted to Carnicera Carmelita Meat Market on the City Council agenda for reconsideration. If reconsideration is approved by the City Council, the variance request will be re-presented at the March 27, 2017 City Council meeting for action.

Justification
The City Council's rules of procedure provide for the reconsideration of an agenda item. Reconsideration can be requested by any Council Member who voted in support of the item/motion and must be supported by two additional members of the City Council.
