Requested Action

To consider the subject easement abandonment.

 

Recommendation

The Engineering Staff recommends the approval of the utility easement abandonment along North Main Street.

 

Description/History

The existing utility easement along North Main Street was created to accommodate a 12" public sanitary sewer that was constructed in 2001 as part of the City's Wastewater Capital Improvement Plan.  The proposed layout of the Main Street Lofts project necessitated a relocation of a portion of the 12" public sanitary sewer within the limits of the project.  An easement to accommodate the new sanitary sewer was created by the developer with the Main Street Lofts plat and an off-site sewer easement.  The new sanitary sewer has now been constructed by the developer, accepted by the City of Mansfield and is in operation.  The utility easement along the abandoned portion of the sanitary sewer may now be abandoned.

 

Justification

A utility easement was created and a new 12" public sanitary sewer was constructed at the sole cost of the developer.  The utility easement containing the now abandoned portion of the 12" sanitary sewer can now be abandoned at no cost or impact to the City of Mansfield.
