Consideration of the special event permit for Eubanks Snow Cones

 

Recommendation

Staff recommends approval with the understanding that an ordinance that governs food trucks and similar uses will be brought before the city council in the near future.

 

Description/History

Mr. Eubanks (the applicant) is requesting a special event permit that would allow him to operate Eubanks Snow Cones, a vintage airstream trailer / snow cone stand, in the parking lot of the Circle S Cleaners at the corner of E. Oak Street and S. Main Street. The applicant owns the building and parking lot on which he wishes to locate the trailer.

Special Events are not permitted in excess of 7 consecutive days. The applicant is requesting authorization to operate the snow cone stand for six consecutive days, Tuesday through Sunday, from May 29th until September 30th. In certain circumstances, city council has approved special event permits for extended periods of time. The Farmers Market and Third Thursdays are examples of such events.

This type of use is not currently permitted in C-2 zoning, however, city staff is preparing an ordinance for city council’s consideration that would address how the City might move forward with food trucks and similar uses in the future. A presentation was made to the Planning & Zoning Commission on Monday, May 21st. Staff intends to schedule a work session in the near future.

Special events shall be subject to any special considerations imposed by the city council for the protection of public interest and welfare of the community.
