Description/History
This new TxDOT Local On-System Improvement Project Agreement (LOSA) was established by Minute Order 115550 and allows the Local Government, at the Local Government’s expense, to perform improvements to the State Highway System and authorizes the State to accept the improvements. This agreement is used when the Local Government is paying 100% of the costs and performing 100% of the work on a TxDOT roadway. The agreement is intended for small projects such as turn lanes, traffic signals, etc. Previously, this type of work was handled by a permit received from the area offices. This formal agreement allows TxDOT to track the start and end dates of projects on State Roadways and allows TxDOT to recoup costs, if applicable, for plan reviews and construction administration.
This specific LOSA is for improvements on FM 157 which are attributable to the Watson Branch development. These improvements will consist of a northbound right turn lane at Watson Branch Lane, north and southbound left turn lanes and a traffic signal. Since TxDOT can only enter into agreements with the Local Government and not developers, the agreement states the Local Government is responsible for 100% of the cost, however the costs for these improvements will be shared between the developer and the City based upon the Developer Agreement that was approved by Resolution #3661-20 on July 13, 2020.
Justification
To construct improvements on FM 157 which will benefit the motoring public and the Watson Branch Development the City must enter into a LOSA with TxDOT. TxDOT will not allow the FM 157 improvements to move forward without the City approving a resolution supporting this agreement. The improvements will be made by the developer through a Developer Participation Contract. The City’s cost for the improvements is capped at $437,879.41 with all other costs by the developer.
The Public Works Director will be in attendance at the meeting to answer Council’s questions regarding this item.
