Consider the subject right-of-way abandonment.

 

Recommendation

The Engineering Staff recommends the approval of the right-of-way abandonment of Miller Rd.

Description/History
Miller Road was reconstructed and realigned in the area just north of Heritage Parkway as a capital improvement project in 2007.  The existing asphalt within this segment of the Miller Road prescriptive right-of-way was no longer needed and was removed with the project.  The western half of the right-of-way was previously abandoned in 2017 to facilitate a development. 

Justification
Staff has agreed that the currently unused eastern half of the prescriptive right-of-way of Miller Rd., as shown on the attached exhibits, is no longer needed by the City.  The realignment of Miller Road allows this Miller Road prescriptive right-of-way to be abandoned and quitclaimed to the adjacent property owners, MCP 360 LAND, LLC and Mansfield IRF, LLC.  These properties are currently being developed as the ClearSky Rehabilitation Hospital on the north lot and retail buildings on the south lot along the SH 360 frontage.  Abandoning this portion of right-of-way will allow this area to be developed.
