Requested Action

Consider an Ordinance adding a new chapter regarding the processing of petitions submitted to the City requesting release from the City’s ETJ.

 

Recommendation

Staff recommends passing of the Ordinance.

 

Description/History

Senate Bill 2038, passed during the 88th Texas Legislature, Regular Session allows for residents of a municipality's extraterritorial jurisdiction (ETJ) to petition for release from ETJ. This in return now requires the municipality to take additional steps in processing the request.  This ordinance would put the procedure in place.

 

Justification

Senate Bill 2038 allows residents of a municipality’s ETJ to petition for release from the ETJ. The bill further provides for a timeline for approving the release of property from the ETJ after a petition is filed with the City.  The proposed Ordinance provides procedures for establishing when a petition is considered filed and provides for a fee to account for the time and effort required by City staff to process the review of the petition and the updating of the City’s maps.

 

Ordinance proposes fee of $300 for processing a petition for release from ETJ.
